WEB HOSTING TERMS AND CONDITIONS
1. Definition and Interpretation In these Web Hosting Terms and Conditions, the following words and expressions shall have the following meanings, (a) "Customer" means any person who applies or subscribes to any Service; (b) "Minimum subscription period" means a period of any length of time as may be stipulated by eWorkz Information as the minimum subscription period before or when the Customer applies for the Service; (c) "Login Name" means any alphanumeric characters assigned by eWorkz Information to the Customer as Login Name, Login ID, User Name or User ID (whether or not selected by the Customer) to be used by the Customer together with the Password to access the Service; (d) "Password" means any alphanumeric characters or symbols assigned by eWorkz Information to the Customer as Password (including any changes thereafter, whether or not selected by the Customer) to be used by the Customer together with the Login Name to access the service; (e) "Virtual Server" means the storage and transfer service over the Internet through the Web server, FTP server and SMTP and POP mail services; (f) "SBA" means the Singapore Broadcasting Authority; (g) "Related Equipment" means such equipment required to access or utilize the Service. 2. Changes to Terms and Conditions eWorkz Information reserves the right to modify these terms and conditions without prior notice to the Customer. The Customer will be notified of the change via eWorkz Information 's website, e-mail or any other access mediums. 3. Change of Usage Plan If the Customer intends to change the usage plan he/she is originally on, he/she will have to notify eWorkz Information of his intention at least fourteen (14) days in advance. Failure to do so may result in delayed activated the new usage plan. 4. Usage of Virtual Server The Customer shall use the Virtual Server in accordance to proper guidelines. eWorkz Information will make no effort to validate the content on the Virtual Server for content, correctness or usability. Should eWorkz Information feel that the content on the Virtual Server violates SBA's guidelines, the Customer will be informed and required to change the content within a reasonable period of time otherwise the Virtual Server will be suspended. 5. Spam Unsolicited e-mail or "Spam" sent from any eWorkz Information's e-mail account is not tolerated. This includes any e-mail that promotes websites hosted by eWorkz Information sent from an e-mail address that is not associated with its account. eWorkz Information will issue a warning to the Customer after the incident of such a violation. After the second violation, the account will be terminated without any warning. 6. Network Abuse The computing and network resources provided should not be abused by the Customer and should be used in accordance to guidelines by eWorkz Information. Should eWorkz Information's network be blocked out by any international or government agencies caused directly or indirectly by the Customer, the Customer concerned will be held liable and made to pay for damages incurred as a result of the network downtime. 7. Termination The Customer is allowed to terminate the Virtual Server services subscribed for, however, two (2) months notice must be given to eWorkz Information in advance in writing. The Customer will still be billed for these two (2) months of service. 8. Billing Unless stipulated, eWorkz Information shall bill the Customer on a half yearly basis or if the Minimum Subscription Period for the Service is less than twelve (12) months, the Customer will be billed for the period of the Minimum Subscription Period. All pricing are subjected to changes and they will be updated on its web site. 9. Payment The Customer shall settle all outstanding balances two (2) weeks from the date of the bill. Failure to do so may result in the suspension of the Service after which: (a) A re-activation fee of $50 applies should the Customer wish to continue using the service; (b) An interest rate of 8% will be charged on a monthly basis on the outstanding amount owed by the Customer. Should the amount be owed by the Customer for a prolonged period, eWorkz Information shall seek legal recourse, and the Customer shall bear all relevant charges, not limited to, attorney's fees, debt collection agency's fees. 10. Password The Customer shall not disclose to any person the Customer's password unless requested by staffs of eWorkz Information for administrative or troubleshooting purposes. Should the Customer compromise the Service due to the disclosure of the Customer's password to unauthorised personels, eWorkz Information shall not be responsible for any damages done. 11. Technical Support (a) eWorkz Information is responsible for providing support the Customer by isolating any specific problems that the Customer encounters while using the Service by phone or e-mail. Technical support is available during office hours from 9a.m to 6p.m; (b) However, eWorkz Information will not provide Technical Support for any programming based requests, such as software installation, debugging / installation of scripts such as CGI, ASP, JAVA and any third party vendor products that are not part of its existing Service; (c) If you require emergency response outside of normal support hours, the service will be chargeable at the standard rate. 12. General The Customer shall be bound by and shall fully observe and comply with all the General Terms as well as such other terms and conditions as may be agreed or accepted by the Customer. 13. Applicable Law and Proceedings This Agreement shall be governed by the laws of Singapore. The Customer irrevocably submits to the non-exclusive jurisdiction of the courts of Singapore.
